On 26 October 2026 the Home Office refreshed Illegal Working Operations guidance for Immigration Enforcement staff. The update reflects Section 48 of the Border Security, Asylum and Immigration Act 2025. From 1 October 2026 the Right to Work Scheme covers workers under a worker's contract, individual sub-contractors, and certain online matching services, not only people on contracts of employment.
If you plan to relocate to the United Kingdom for work in late 2026, treat right to work proof as part of your move plan. Clients, agencies, and platforms now face civil penalty risk when engagements begin on or after 1 October 2026. Arrangements signed before 1 October 2026 stay outside the new civil penalty rules for those wider work types.
What the 1 October 2026 Right to Work expansion covers
The Employer's guide to right to work checks dated 1 October 2026 sets out the new scope. An "employer" for the Scheme now includes a person who engages someone under a worker's contract, engages an individual sub-contractor, or operates an online matching service providing details of a service provider to potential clients or customers.
Extended liability under new section 15A of the Immigration, Asylum and Nationality Act 2006 reaches beyond the direct contractor in three common structures:
- a business contracted to supply work or services to a third party then contracts with another employer to supply the workers
- an online matching service pairs a service provider with a client, and the provider contracts with the client
- a contract allows substitution, and another person does the work in place of the named worker
Home Office guidance stresses substance over labels. Calling yourself a freelancer does not decide Scheme coverage. Officers look at who engages you and whether the arrangement buys a person's labour or an independent business outcome.
Two outs sit in the 1 October guide. A self-employed tradesperson who advertises direct to the public and works for many customers outside a matching platform sits outside the Scheme in the plumber example. A graphic designer engaged through a personal service company for a project outcome also sits outside client-side checks. Intermediaries and matching platforms remain in scope when the arrangement supplies a person rather than an independent firm's finished service.
Civil penalties and why your first UK clients care
GOV.UK states an employer faces a civil penalty of up to £60,000 for each illegal worker when right to work checks fail or never happen. Criminal liability remains for employing someone when the employer knew, or had reasonable cause to believe, the person lacked permission for the work.
For worker's contracts, individual sub-contractors, and online matching services, civil penalties apply only where the engagement began on or after 1 October 2026. Tell every new UK client the start date of your engagement and offer a share code before day one.
Three prescribed check methods give a statutory excuse:
- a manual document-based right to work check against List A or List B
- a Home Office online right to work check using a share code beginning with W
- a check through a Right to Work digital verification service provider
Share codes last 90 calendar days. Generate a fresh code on GOV.UK under Prove your right to work to an employer. Codes beginning with R serve right to rent, not right to work. Keep copies of the check result for the statutory excuse period.
Visa routes for people moving to work in the UK
Right to work checks test permission already granted. The checks do not replace a visa. Most long-term movers still need a Skilled Worker grant or another work route before any platform or agency run a check.
For Skilled Worker, GOV.UK requires an eligible job with an approved sponsor and pay at the higher of £41,700 a year or the going rate for the occupation code. Medium-skilled roles need Immigration Salary List, Temporary Shortage List, or another listed exception. You must apply within three months of receiving your Certificate of Sponsorship.
Standard Skilled Worker fees from outside the UK stand at £819 for permission of up to three years and £1,618 for more than three years. Inside the UK the same bands stand at £943 and £1,865. Immigration Salary List roles use lower fees of £628 or £1,235. The Immigration Health Surcharge for most adult workers is £1,035 per year of permission. Maintenance funds of £1,270 usually apply for new arrivals unless the sponsor certifies maintenance or you already held UK permission for 12 months.
Temporary Shortage List occupations keep a hard planning date. Certificates of Sponsorship for Temporary Shortage List roles must issue before 31 December 2026 for occupations still on the interim list, unless Rules change again. If your job sits on Temporary Shortage List, push sponsor filing before year end.
Skilled Worker permission ties you to a sponsored role. Secondary employment has strict hour and skill limits. Self-employment on Skilled Worker remains barred except where Home Office conditions change after a positive Conclusive Grounds modern slavery decision under SW 18.3. Freelance platforms do not create a free-standing work right for sponsored workers.
Where freelance work fits after you arrive
British and Irish citizens, people with settled or pre-settled status, and holders of permission without a work ban already hold a broad right to work. For those groups the 1 October expansion mainly changes how platforms and agencies check identity before work starts.
If you hold Graduate route permission after UK study, you hold unrestricted work rights for the grant period, including self-employment. Right to work checks still apply when a platform or agency engages you on or after 1 October 2026. Keep digital status ready and practise generating a W share code before client calls. If you hold Visitor permission, paid work remains off limits.
City choice shapes rent, desk cost, and client density once your immigration status allows trade. A practical comparison of day rates against one-bed rents across London, Manchester, Leeds, and other large cities sits in the best UK cities for freelancers in 2026 guide. Use rent days as a budget test before you sign a tenancy, then confirm your visa conditions allow the work you plan to sell.
Relocation checklist for late 2026 arrivals
Build a document pack before you book flights.
- Valid passport and current digital immigration status or biometric documents
- Certificate of Sponsorship number and job description matching the occupation code
- Bank statements covering maintenance funds for 28 consecutive days when required
- English language evidence already accepted on your route
- Proof of National Insurance number once HMRC issues one after arrival
- A tested GOV.UK account able to create a right to work share code within minutes
Open a UK bank account early. Many landlords and agencies demand a UK account for rent and invoices. Keep landlord right to rent checks separate from employer right to work checks. R codes and W codes serve different purposes.
For sponsored roles, ask your sponsor Level 1 user how payroll, hours, and secondary work will be reported on the Sponsor Management System. Home Office and HMRC data sharing now supports compliance checks on pay rates, unpaid leave, and excess secondary hours. Report changes within the sponsor deadlines, often 10 working days for material changes.
How clients and platforms will treat you
Expect slower onboarding. Agencies and matching services need a completed check before work starts to keep a statutory excuse. Send the share code and date of birth in the same message. Offer a manual document path when online checks fail. If a client asks you to start before the check finishes, refuse.
Sole traders who sell direct to many customers without a matching intermediary often sit outside Scheme checks under the independent business examples. Once you join an agency or platform matching you to clients, treat Scheme checks as normal.
Planning steps for the next 60 days
If you already hold UK work permission, generate a share code this week and store the screenshot with your contracts. If you still wait for a Skilled Worker decision, confirm the Certificate of Sponsorship dates against Temporary Shortage List cut-offs and fee bands. If you plan self-employment after a Graduate grant, shortlist cities by rent and sector demand before you commit to a long lease.
The Right to Work expansion does not create new visas. The expansion changes who must check your status before paid work begins. Pair a lawful visa plan with clean check readiness.
