UK HC 584 Rules Take Effect From 8 October 2026

Most UK Immigration Rules changes in Statement of Changes HC 584 start on 8 October 2026. Religious routes follow on 29 October. Student funds rise on 30 November. Check your route before you file.

On 3 September 2026 the UK Home Office laid Statement of Changes HC 584 before Parliament. Most amendments start on 8 October 2026. Later stages follow on 29 October 2026 for religious work routes, on 30 November 2026 for Student maintenance funds, and on 9 December 2026 for one EU Settlement Scheme identity rule. HC 584 does not alter Skilled Worker salary thresholds and does not introduce earned settlement. The package still reaches visitors, sponsors, students, families, Hong Kong BN(O) households, and EU Settlement Scheme holders. Plan filing dates against the correct commencement day before you submit.

Primary sources sit on GOV.UK. Read the Statement of Changes HC 584 page and the Home Office explanatory memorandum published on 3 September 2026.

Commencement dates and transitional rules

HC 584 uses staggered start dates. Treat each route as a separate calendar item.

  • 8 October 2026: most amendments, including Visitor and Erasmus+ activity rules, Skilled Worker modern slavery protections, fee waiver and variation controls, Part Suitability wording, Victim of Domestic Abuse expansion, most EU Settlement Scheme changes, Hong Kong BN(O) child settlement, and Long Residence variation rules.
  • 29 October 2026: Appendix T2 Minister of Religion and Appendix Temporary Work - Religious Worker.
  • 30 November 2026: annual uplift to Student and Child Student maintenance funds.
  • 9 December 2026: end of expired biometric residence permit use as EU Settlement Scheme identity evidence.

Some 8 October changes include a saving rule. For those provisions, an application for entry clearance, an Electronic Travel Authorisation, permission to enter, permission to stay, a claim, or administrative review made before 8 October 2026 is decided under the Immigration Rules in force on 7 October 2026. Visitor, Student, family, private life, fee waiver, and Part Suitability items sit in this group.

A second group applies to decisions from 8 October 2026 with no matching saving rule. Skilled Worker modern slavery variation, EU Settlement Scheme amendments, Hong Kong BN(O) settlement for dependent children, Long Residence variation, and Victim of Domestic Abuse expansion fall here. Pending files in those routes face the new text once the clock hits 8 October 2026.

Visitors and Erasmus+ mobility

From 8 October 2026, visitors who take permitted training in the United Kingdom no longer need to prove the training is unavailable in the home country. Artists, entertainers, and musicians gain rehearsal attendance as a permitted activity. Entertainment staff gain scope to assist with permitted performance work. All visitors gain access to workshops, debates, and skills competitions when eligibility rules are met. The core visitor test stays in place. You still need to show genuine visitor intent and departure at the end of the stay.

HC 584 also prepares immigration routes for UK association to Erasmus+ from 2027. The UK Government and European Commission announced agreement on association on 17 December 2025. Eligible Erasmus+ participants gain short traineeships of up to 30 days, job shadowing, training, courses, and sports coaching assignments under the Visitor route. State funded schools and academies gain scope to host Erasmus+ study placements of up to six months when Visitor eligibility holds.

Appendix Student and Appendix Child Student also receive Erasmus+ exemptions. Sponsors in the scheme gain authority to sponsor Erasmus+ courses even when the course does not lead to an approved qualification. Sponsorship at RQF level 2 becomes available for Erasmus+ participants at participating sponsors. Government Authorised Exchange adds an Erasmus+ scheme entry. The explanatory memorandum cites about 60,000 Erasmus+ participants who came to the United Kingdom in 2019 and expects higher demand after reassociation.

Skilled Worker modern slavery protection

Skilled Worker permission normally ties you to the sponsored role. From 8 October 2026, a Skilled Worker who receives a positive conclusive grounds decision as a victim of modern slavery during current permission faces a new pathway. Home Office decision makers hold power to vary conditions so the person works for any employer for the rest of current permission. Professional sportsperson work stays excluded. Sponsors should expect a varied worker to leave the original Certificate of Sponsorship relationship.

Fee waivers, variation, and suitability

Section 3C of the Immigration Act 1971 extends permission while an in-time application awaits a decision. From 8 October 2026, the application filed after a fee waiver decision must match the application named in the fee waiver request. Variation of an application does not restart the biometric enrolment period. One enrolment window applies. Applicants who rely on section 3C leave need careful timing advice before any variation.

Part Suitability also hardens. From 8 October 2026, a person who previously failed to report while on immigration bail, or who absconded from bail or custody, counts as having breached Immigration Laws for suitability refusal purposes. Appendix FM and Appendix Private Life also formalise a path for families inside the Family Returns Process to raise Article 8 claims with Home Office staff without a formal paid form fee.

Families, domestic abuse, and Hong Kong BN(O)

Appendix Victim of Domestic Abuse currently covers partners and children whose relationship broke down because of domestic abuse. From 8 October 2026, adult dependent children whose relationship with the visa sponsor broke down because of domestic abuse also gain eligibility. The Home Office links the expansion to Northern Ireland High Court order JR337 Application for Judicial Review [2026] NIKB 12.

On the Hong Kong British National (Overseas) route, dependent children no longer need a separate five-year continuous residence period to settle with parents. From 8 October 2026, eligible dependent children settle alongside parents when the parents meet settlement requirements.

EU Settlement Scheme and Long Residence

Several EU Settlement Scheme changes start on 8 October 2026. Some pre-settled status holders who no longer meet the original eligibility basis keep status when removal would be disproportionate, with a path toward settled status later. Joining family members generally face a three-month deadline from latest lawful entry after the transition period ended on 31 December 2020. The travel permit route closes. Status holders use the Update My Details service instead, including from outside the United Kingdom, to link status to a new passport. Children with pre-settled status whose EU citizen parent was formerly a worker or self-employed person in the United Kingdom keep status, with the primary carer, so education continues, reflecting Court of Appeal guidance in Ayoola v SSHD [2025] EWCA Civ 1519. From 9 December 2026, an expired biometric residence permit no longer serves as identity evidence under the scheme.

From 8 October 2026, when a permission-to-stay application on the ten-year Long Residence route fails Long Residence requirements but shows a realistic family life or private life basis, the Home Office varies the application to Appendix FM or Appendix Private Life. No further application fee is charged. The Immigration Health Surcharge still needs payment or a granted waiver. Failure to pay without a waiver request leads to rejection as invalid.

Student funds and religious work routes

Student maintenance funds rise on 30 November 2026 to match 2026/27 home student maintenance loan levels. Monthly living cost figures move from £1,529 to £1,570 in London and from £1,171 to £1,203 outside London. The maximum accommodation offset rises to £1,570. Applications made before 30 November 2026 stay under the figures in force on 29 November 2026. For a nine-month course in London under the new figures, living cost funds reach £14,130 before unpaid course fees. Outside London the nine-month figure reaches £10,827 before unpaid course fees.

From 29 October 2026, Appendix T2 Minister of Religion gains exemptions for members of religious orders from the rule against mainly non-pastoral duties. The upper time limit on the route is removed. Financial assessment changes when the worker is exempt from the National Minimum Wage. Appendix Temporary Work - Religious Worker replaces the advertising rule with an affiliation requirement to the sponsoring faith organisation.

Map your route to the correct start date. File before 8 October 2026 only when a saving rule protects your case and older wording helps you. Do not assume every pending file keeps the 7 October 2026 text.

  • Visitors and training planners: drop the old unavailable-at-home training proof once the new Visitor rules apply to your filing.
  • Sponsors: brief HR on modern slavery conclusive grounds variations and on religious route affiliation evidence from 29 October 2026.
  • Students aiming to file near late November: budget for £1,570 or £1,203 monthly maintenance and the £1,570 accommodation offset.
  • EU Settlement Scheme holders: prepare valid passport evidence before 9 December 2026 and use Update My Details for passport changes.
  • BN(O) families with dependent children: check settlement timing so children settle with parents under the revised continuous residence rule.
  • Long Residence applicants: keep funds ready for any Immigration Health Surcharge demand after a variation notice.

Confirm the exact paragraph numbers for your route on the GOV.UK HC 584 publication before you file. Track Home Office guidance updates on the day each change takes effect. MigrantIQ will continue to watch UKVI practice notes as officers apply the new text from 8 October 2026 onward.
