Australia Forces Offshore Student Visa Lodgement From 2 October 2026

From 2 October 2026 Australia requires many temporary visa holders to lodge Subclass 500 and 590 applications offshore. Check your subclass on VEVO, exemptions, and family rules before you enrol or travel.

Assistant Minister Julian Hill signed the Migration Amendment (Student Visa Reform) Regulations 2026 (F2026L01347) and the Migration (Student Visa Applications to Be Made from outside Australia) Instrument 2026 (LIN 26/102 / F2026L01348) on 1 October 2026. Both instruments commence on 2 October 2026. LIN 26/102 repeals LIN 26/068. The stated purpose is to stop temporary migrants who entered Australia for non-study reasons from lodging Subclass 500 or Subclass 590 applications to prolong stay through visa hopping.

Home Affairs published a public factsheet on the new Student visa application rules. The factsheet warns readers to read the requirements before enrolling, before booking travel, and before lodging. Applications lodged before 2 October 2026 stay under the old rules. Files lodged from 2 October 2026 face the offshore and family limits described below.

Authority for the offshore lodgement list sits in paragraph 1222(5)(e) of Schedule 1 to the Migration Regulations 1994 for subparagraph 1222(4)(a)(ii). Invalid onshore applications receive no consideration under section 47(3) of the Migration Act. If the new rules force you offshore, you must sit outside Australia at lodgement and again at grant.

Temporary visas forced to lodge Subclass 500 or 590 offshore

Holders of the following temporary visas must lodge Subclass 500 or Subclass 590 applications from outside Australia:

  • 400 Temporary Work (Short Stay Specialist)
  • 407 Training
  • 408 Temporary Activity
  • 417 Working Holiday
  • 457 Temporary Work (Skilled)
  • 462 Work and Holiday
  • 482 Skills in Demand and Temporary Skill Shortage streams
  • 485 Temporary Graduate
  • 600 Visitor
  • 601 Electronic Travel Authority
  • 602 Medical Treatment
  • 651 eVisitor
  • 771 Transit
  • 988 Maritime Crew

Two further subclasses face limited coverage. Subclass 403 holds the restriction only for the Domestic Worker (Diplomatic or Consular) stream. Subclass 995 holds the restriction only for Diplomatic primary holders under Division 995.2. For every other listed subclass, the offshore rule applies across streams and across primary and secondary status.

Check your current subclass on VEVO before you book a course or a flight. A listed subclass means you plan departure before you lodge. A short day trip fails if grant arrives after you re-enter. You must remain outside Australia when Home Affairs grants the Student visa as well as when you lodge.

Current Student visa holders seeking another Student visa

Existing Subclass 500 holders who seek another Student visa generally must lodge offshore unless a Home Affairs exemption applies. The same offshore default covers a dependant Student holder who wants to switch to primary status. The reform does not cancel your current Student visa. Your present grant continues under the conditions already printed on the label or grant notice.

Student Guardian (Subclass 590) holders keep a different path. A current 590 holder remains free to lodge a further 590 application while inside Australia. The offshore list and the further-Student offshore default target Subclass 500 renewals and first Student lodgements from the listed temporary subclasses, not further Student Guardian filings by people already on 590.

Onshore exemptions for another Student visa

Home Affairs lists narrow exemptions for a current Student visa holder who wants to lodge another Student visa while still in Australia. Match your facts to one exemption before you treat an onshore lodgement as valid.

  • You need up to 12 more months after the original course end date to finish studies with the same education provider. For a packaged set of courses, the extra time must cover your main course.
  • You hold DFAT or Defence sponsorship.
  • You seek a PhD place.
  • You seek primary or secondary school studies.
  • You completed your main AQF course and progress to a higher AQF level. After a completed higher education course, the next course must also be higher education delivered by a higher education provider.
  • You completed school studies and progress to a non-AQF course.
  • You completed a non-AQF course and progress to an AQF course.
  • Your education provider defaulted, so you are unable to continue the enrolled course.

Absence from every exemption means you leave Australia, lodge from outside, and wait offshore for grant. Do not rely on informal campus advice. Compare your written course dates, CoE, and AQF level against the Home Affairs factsheet wording before you press submit in ImmiAccount.

Family members and subsequent entrants

Student visa applicants generally lose the option to include a partner or dependent children unless a family exemption applies. Current Student visa holders also lose the path to add family as subsequent entrants after grant. Home Affairs states no exemptions exist for subsequent entrants after grant.

Exemptions to include family at lodgement cover four groups. PhD applicants sit in the first group. DFAT or Defence sponsored applicants sit in the second. Foreign government scholarship holders sit in the third. Eligible students who hold a Pacific country passport or an ASEAN member country passport sit in the fourth.

One further family path exists for people already inside Australia on a Student visa. If family members already sit on your current Student visa, and you lodge the next Student visa application in Australia under an onshore exemption, Home Affairs allows those same family members in the next application. The primary applicant and every included family member must share the same location at lodgement. Split locations between Australia and abroad invalidate the family package for lodgement purposes.

Fees and evidence to gather before you lodge

Home Affairs lists the Subclass 500 visa application charge for the main applicant at AUD 2,500 on current pricing pages after the 1 July 2026 fee update. Secondary applicant charges and concessional bands for some Pacific and ASEAN cohorts change by circumstance. Confirm the live total on the Visa Pricing Estimator on immi.homeaffairs.gov.au before you pay. Do not rely on a blog figure for secondary fees.

Assemble evidence before you leave Australia if the offshore rule applies to your subclass. Gather a Confirmation of Enrolment (CoE) for every course in your package. Arrange Overseas Student Health Cover (OSHC) for the full proposed stay. Collect English language evidence matching the course level Home Affairs expects. Prepare financial capacity documents for tuition, living costs, and travel. Keep passport biodata pages, previous grant notices, and VEVO screenshots in one folder.

Log into ImmiAccount only after you clear immigration departure. Lodge the Subclass 500 or Subclass 590 form from outside Australia. Stay outside until grant arrives. Track processing times on the Home Affairs global visa processing times page, yet treat published medians as planning guides rather than promises. A grant notice received while you sit back inside Australia fails the outside-at-grant rule for people forced offshore by LIN 26/102.

Practical steps for readers this week

  • VEVO check: Confirm your live subclass and stream tonight. Match the number against the LIN 26/102 list, including the 403 Domestic Worker limit and the 995 Diplomatic primary limit.
  • Course timing: Ask your provider for written course end dates and package structure before you claim a 12-month completion exemption or an AQF progression exemption.
  • Travel plan: If your subclass sits on the offshore list, book departure early enough to lodge and wait for grant abroad. Build buffer days around typical processing ranges.
  • Family plan: Decide whether a PhD, DFAT or Defence, foreign scholarship, or Pacific or ASEAN passport exemption covers family inclusion. Otherwise plan solo lodging and separate later pathways.
  • Fee check: Run the Visa Pricing Estimator for your exact applicant set on the day you pay. Record the AUD 2,500 main-applicant figure only as the commonly listed primary charge.
  • Old-rule files: Keep proof of lodgement date for any Student visa application submitted before 2 October 2026. Officers assess those files under the rules in force on the lodgement day.

Read the Migration Amendment (Student Visa Reform) Regulations 2026 and LIN 26/102 on legislation.gov.au for the black-letter text. Read the Home Affairs Student visa reform factsheet for the exemption list in plain language. Cross-check Subclass 500 guidance on immi.homeaffairs.gov.au before you enrol or relocate. MigrantIQ will watch further Home Affairs practice notes as officers apply the 2 October 2026 commencement across ImmiAccount lodgements.
